Organization:

These Terms govern your use of the Site and any services we offer (newsletters, donations, downloads). By using the Site, you agree to these Terms.

The Justice Frank Drowota Trust (“we,” “our,” “us”)

Acceptance of Terms:

By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

About the Trust:

The Trust is a nonprofit providing grants to direct legal service providers in Tennessee.

Eligibility & Geographic Scope:

The Site is intended for users located in the United States and at least 13 years old.

Donations & Receipts:

 Donations are processed by third-party providers (e.g., Zeffy). We issue electronic receipts for successful transactions.

Recurring Donations; Updating/Canceling:

If you enroll in recurring donations, you authorize periodic charges until you cancel via the link in your receipt or by contacting us.

Refunds / Chargebacks:

Donations are generally non-refundable. If a donation was made in error, contact us within  5 days and we’ll review.

Tax Deductibility:

Donations may be tax-deductible to the extent allowed by law; please consult your tax advisor.

Informational Only; No Legal Advice:

Content on the Site is for general informational purposes and is not legal advice; no attorney-client relationship is created.

Intellectual Property; Limited License:

The Site (text, graphics, logos, photos) is owned by the Trust or our licensors and protected by law. We grant you a limited, non-exclusive, non-transferable license to view and use the Site for personal, noncommercial purposes.

User Submissions:

If you submit content (e.g., messages, testimonials), you grant us a non-exclusive, royalty-free license to use, reproduce, and display it for our mission and communications, subject to our Privacy Policy.

Prohibited Uses:

You agree not to: violate laws; attempt to gain unauthorized access; interfere with the Site; post harmful, defamatory, or infringing content; or use automated scraping without permission.

Third-Party Services & Links:

The Site may link to or embed third-party services (e.g., Zeffy for donations, Flodesk for email, analytics tools). We are not responsible for their content or policies.

Accounts (if any):

If we provide account access (e.g., course or portal), you are responsible for maintaining the confidentiality of your login and all activities under your account. We may suspend or terminate access for violations.

Accessibility:

We aim to provide an accessible experience and welcome feedback . 

Disclaimers:

The Site is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.

Limitation of Liability:

To the maximum extent permitted by law, the Trust and its officers, directors, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Site.

Indemnification:

You agree to indemnify and hold the Trust harmless from claims arising out of your use of the Site or violation of these Terms.

Changes to the Site or Terms:

We may modify or discontinue the Site, and we may update these Terms from time to time. The Effective date reflects the latest revision. Your continued use after changes means you accept the updated Terms.

Termination:

 We may suspend or terminate access to the Site at any time for any reason, including violations of these Terms.

Communications; Electronic Records:

You consent to receive communications electronically and agree that electronic records and signatures satisfy legal requirements.

Miscellaneous:

These Terms constitute the entire agreement regarding the Site. If any provision is unenforceable, the remainder remains in effect. Our failure to enforce a provision is not a waiver.

 These Terms are governed by the laws of the State of Tennessee, without regard to conflicts principles. Exclusive venue lies in the state or federal courts located in Knox County, Tennessee.
